This Privacy Policy (“Privacy Policy”) addresses the privacy practices of MyPeople, Inc., (“MyPeople,” “We,” or “Us”), and the possible uses of the information that is collected, used, shared, and secured via Mypeople.earth (the “Website”) through the Mypeople.earth application (“App”) and via other submissions by the user (“You” or “Your”) to MyPeople. This Privacy Policy applies to all MyPeople’s services, as offered on and in connection with the Website and App (“Services”). This Privacy Policy is likewise incorporated in the terms of the MyPeople.earth website.
MyPeople allows You to invite friends, set up groups, share videos and pictures, and send and receive messages with other people throughout the world that share a common heritage and/or common interest. You can create online communities and connect with people, places, and cultures based on common heritage and interests.
By using the Services, You consent to the terms of this Privacy Policy. If You do not agree to the terms and conditions of this Privacy Policy, including having Your personal information (“Personal Information”) used in any of the ways explained in this Privacy Policy, You should discontinue using the Website and Services.
MODIFICATIONS OR CHANGES
MyPeople may, in its sole discretion, modify or change this Privacy Policy, at any time, effective upon posting the modified or changed Terms of Use on the Website and by providing You with notice of such modification or change by contacting You through the email address provided as part of your registration. Any such changes will not apply to any claim brought prior to the date where MyPeople posted the revised Privacy Policy incorporating such modifications or changes.
MyPeople may modify, update, suspend, or discontinue the Services, in whole or in part, at MyPeople’s sole discretion for any or no reason, at any time, and with or without notice.
If You do not agree to any of the amended terms, You agree to immediately stop using the Services. Your continued usage of the Services after such posting of modification or change means that You accept and agree to be bound by the amended Privacy Policy.
INFORMATION COLLECTED AND USE OF INFORMATION
Information Collected:
MyPeople collects information about You in various ways, such as by Your voluntary submissions, postings, and participation in services provided via the Website and Services from third-parties with Your consent and through cookie and other tracking technology.
Personal Information
“Personal Information” includes, but is not limited to, information that tells MyPeople specifically who You are. For example, this may include Your name, phone number, email, address, and possibly information relating to certain support or customer service issues. The definition of Personal Information may vary from jurisdiction to jurisdiction. The use of the defined term in this Privacy Policy of “Personal Information” does not mean, nor is it intended to acknowledge or admit, that the Personal Information You provide to MyPeople meets the definition of “Personal Information” in any jurisdiction, including the one where You reside.
Submission of User Generated Content
MyPeople collects information that You voluntarily provide as part of MyPeople’s Website and Services, such as Your Personal Information and any other information You submit through the Website and Services (“User Generated Content”). MyPeople may in its sole discretion share Your User Generated Content with other users. If You wish not to have certain information shared with others, You should not submit User Generated Content, nor should You submit User Generated Content containing information or Personal Information You do not want shared in this manner. Once You have submitted User Generated Content, MyPeople reserves the right to publish it to others.
Collective Information
MyPeople may collect general, non-personal, statistical information about the use of its Website and Services, i.e., how many visitors visit a specific page on the Website, how long they stay on that page, and which hyperlinks, if any, are clicked on. This information represents a generic overview of its users, including collective viewing habits, and allows MyPeople and other third-parties to modify information, promotions, and/or offers on services pursuant to user traffic and behavior. MyPeople collects this information by using technologies such as cookies, which is further discussed below. MyPeople collects this information to help enhance the Website and Services and to make a better visitor experience for You.
Third-Party Information
MyPeople may supplement information You provide to it with information from other sources. In addition, MyPeople uses this information to help it maintain the accuracy of the information it collects, to enable it to fulfill its services, to target its communications so that it can inform You of services and offers that may be of specific interest to You, and for internal business analysis or other business purposes consistent with MyPeople’s mission.
Cookies
MyPeople may automatically collect non-personally identifiable information and data using cookies. Cookies are small text files a website uses to recognize repeat users and facilitate the user’s ongoing access to the website and use of the website. Cookies also allow a website to track usage behavior and compile website usage information, allowing for the continued improvement of content and target advertising. Most browsers allow You to control cookies, including whether to accept them and how to remove them. You may set Your browsers to notify You if You receive a cookie, or You may choose to block cookies with Your browser. Notwithstanding, please be aware that some features of MyPeople’s Website and Services may not function or may be slower if You refuse cookies. You may also get cookies from MyPeople’s advertisers or other third-parties with links on the Website, which is described below. To be clear, MyPeople does not directly control these cookies. The use of advertising cookies sent by third-party ad servers is standard in the internet industry. Some cookies will remain on Your computer after You have left the Website.
MyPeople may use the services of third-parties to collect and use anonymous information about Your visits to and interactions with its website using technologies such as cookies to personalize advertisements for goods and services.
Opt-Out Choices
You may choose whether to receive some Interest-based Advertising by submitting opt-outs. In order to opt-out of any Interest-based Advertising, You must send an email to privacy@mypeople.earth and specify You would like to opt-out of receiving Internet-based Advertising. Please be aware, even if You are able to opt-out of certain kinds of Interest-based Advertising, You still may continue to receive other types of ads in your feed as you use the MyPeople Services. Opting-out only means that those selected members should no longer deliver certain Interest-based Advertising to You, but it does not mean You will no longer receive any targeted content and/or ads from other ad networks.
Other Tracking Technologies
Tracking technologies may record information that includes the following: Internet domain and host names; protocol addresses (IP address); browser software and operating system types; clickstream patterns; the MAC address or other technical information from Your mobile device; location information through GPS, WiFi, Bluetooth, or similar technologies; and dates and times that MyPeople’s Website and Services are accessed. An IP address is a number that is automatically assigned to Your computer whenever You are surfing the web. Web servers, the computers that ‘serve up’ web pages, automatically identify Your computer by its IP address. The Website and Services may also use technology called “tracer tags.” These may also be referred to as “Pixels,” “Clear GIFs,” or “Web Beacons.” This technology allows MyPeople to understand which pages You visit on its Website and other ways You interact with its Website and Services, including communications made through the Website and Services. These tracer tags are used to help MyPeople optimize and tailor its Website and Services for You and other users of its Website and Services. MyPeople may link the information it records using tracking technologies to Personal Information MyPeople collects.
Use of Personal Information:
In general, MyPeople does not and will not share Your Personal Information, except as set forth in this Privacy Policy. MyPeople does not sell, transfer, and/or share Your Personal Information with third-parties for its own marketing purposes. Any data shared is for the purpose of the Services. The certain Personal Information provided will be shared with other users of the Services as part of the online community. By using this site and the Services, You specifically consent to such sharing of Personal Information.

DISCLOSURES AND TRANSFERS OF INFORMATION
MyPeople does not disclose Personal Information to third-parties and will take all action appropriate to challenge the disclosure of Personal Information unless required to do so by law and/or except when one (1) or more of the following conditions is true:
● MyPeople obtains Your permission to make the disclosure;
● The disclosure is necessary for the purpose that the personal information was obtained;
● The disclosure is to financial service providers in order to fulfill and carry out the services requested by You;
● The disclosure is permitted by relevant law;
● The Personal Information to be disclosed is otherwise publicly available in accordance with the applicable law;
● The disclosure is reasonably related to the sale or other disposition of all or part of MyPeople’s business or assets;
● The disclosure is for MyPeople’s own marketing purposes or, with Your authorization, for the marketing purposes of third-parties;
● The disclosure is combined with information collected from other companies and used to improve and personalize services, content, and advertising from MyPeople or third-parties;
● The party to whom the disclosure is made controls, is controlled by, or is under common control with MyPeople;
● The disclosure is in MyPeople’s sole discretion necessary for the establishment or maintenance of legal claims or legal compliance, to satisfy any law, regulation, subpoena or government request, or in connection with litigation;
● The disclosure is in MyPeople’s sole discretion about users who MyPeople believes are engaged in illegal activities or are otherwise in violation of the Terms of Use, or other MyPeople agreements, even without a subpoena, warrant, or court order; or
● The disclosure is to outside businesses to perform certain services for MyPeople, such as maintaining the Services, mailing lists, processing orders and delivering products and services, sending postal mail, providing marketing assistance, confirming Your identity for review integrity, and data analysis (“Administrative Service Providers”) that includes Administrative Service Providers outside the country or jurisdiction where You reside.
The Personal Information is collected directly by MyPeople. However, data analytics may be done by a third-party. MyPeople data is stored on Amazon Web Services (“AWS”), and it uses Google Analytics for usage data. No Personal Information is shared with Google.
Prior to sharing Your Personal Information with others, agreements are made between MyPeople and those outside parties to whom MyPeople is transferring data to provide for the allowable use and security of the transferred information in accordance with this Privacy Policy and any applicable law. If MyPeople becomes aware that any such outside party is improperly using or disclosing Personal Information, it will notify that outside party and request that the outside party take reasonable steps to cease such use or disclosure.
MyPeople may provide certain Personal Information as a service to others for their marketing purposes. It may also disclose Your name and address to Service Providers when You submit User Generated Content relating to those Service Providers. If You properly notify MyPeople that You no longer want it to share Your Personal Information, MyPeople will stop sharing Your Personal Information. On the other hand, and except as otherwise stated in this Privacy Policy, MyPeople does not directly control the third-parties with whom MyPeople shares such Personal Information. Be advised that You will need to further notify such third-parties directly if You would like those third-parties to stop using Your Personal Information.
ACCESSING YOUR INFORMATION
To help You review, edit, and control how MyPeople uses much of the information it collects about You, You can visit “Your Account” by logging into the MyPeople website.
In “Your Account,” You can access and update certain information and unsubscribe from receiving specific types of email messages placed by MyPeople or a third-party on its behalf. You cannot, however, unsubscribe from receiving certain email unless You unsubscribe to the Services entirely.
You can also ask MyPeople the following: whether it is keeping information about You; how Your information is being used; to update or correct Your information; or to opt-out of MyPeople’s collection and use of certain information by sending an email to privacy@mypeople.earth. If You choose to opt-out of the collection and use of certain information, You understand and acknowledge that some services may no longer be available to You, potentially requiring the cancellation of Your Account. MyPeople may require proof of Your identity before it provides You with the requested information.
DATA SECURITY, INTEGRITY, AND ACCESS
The Personal Information You provide and MyPeople collects is stored using AWS. As MyPeople deems necessary and as required by applicable law, MyPeople uses security measures appropriate for the sensitivity of the Personal Information and consistent with industry standards and legal obligations. These security measures include physical, organizational, and technological protections, such as, but not limited to, firewalls and encryption technology to protect Your Personal Information, and password information. Nonetheless, it is commonly acknowledged that no security system is impenetrable. MyPeople does not and cannot therefore guarantee the security of its databases. Likewise, MyPeople cannot guarantee that the information You supply will not be intercepted while being transmitted to MyPeople over the Internet.
Some Personal Information that You share with other users will be accessible to those other users as part of the Services. Other information may only be accessed by persons within MyPeople, MyPeople’s third-party service providers who require such access to provide You with the services indicated above, or any other party that You have provided MyPeople with authorization to share such information.
MyPeople retains Personal Information that it collects only if reasonably necessary to fulfill the purposes for which the information was collected or to otherwise meet any legal requirements.
Your information may be transferred to, and maintained on, computers located outside of Your state, province/territory, or country where privacy laws may not be as protective as those where You live. If You are located outside the United States and choose to provide information to MyPeople, please be aware that MyPeople transfers Personal Information to the United States and then processes and stores it there. As a result, this information may be subject to access requests from governments, courts, law enforcement officials, and national security authorities in the United States according to its laws. Subject to any applicable laws, MyPeople will use reasonable efforts to ensure that appropriate protections are in place to maintain protections on Personal Information. By submitting Your Personal Information, You consent to having Your Personal Information transferred to, processed, and stored in the United States. You will obtain a username and password that allows for access to the Website and Services. Your username and password should be strictly accessed and only used by You. You may not share Your username and password with anyone else, and You are solely responsible for maintaining and protecting the confidentiality of Your username and password. You are fully responsible for any and all activities that occur under Your username and password.
THIRD-PARTY WEBSITES AND LINKS
Please note that You may have cookies placed on Your computer by third-party websites that refer You to the Website. Although MyPeople does not share Your Personal Information with these third-party websites unless You have authorized MyPeople to do so, these third-party websites may be able to link certain non-personally identifiable information MyPeople transfers to it with Personal Information the third-party websites previously collected from You. MyPeople strongly encourages You to review the privacy policies of each website You visit to better understand its privacy practices. Additionally, MyPeople would like to inform You that anytime You click on links which take You to third-party websites, You will be subject to the third-parties’ privacy policies. While MyPeople supports the protection of its customers’ privacy on the Internet, MyPeople expressly disclaims any and all liability for the actions of third-parties, including but without limitation actions relating to the use and/or disclosure of Personal Information by the third-parties.
The Website and Services may contain links to other websites operated by third-parties. MyPeople does not control other websites and is not responsible for its content, privacy policies, or use of Personal Information. MyPeople’s inclusion of such links does not, by itself, imply any endorsement of the content on other websites, nor of its owners or operators except as disclosed on the Website and Services. Any information submitted by You directly to these third-parties is subject to the third-party’s privacy policy.
CHILDREN’S PRIVACY
MyPeople does not intend the Website and Services to be used by individuals under the age of majority within the jurisdiction within which the individuals reside without the express supervision of a parent or guardian of majority age. MyPeople relies upon parents or guardians to determine if the Website and Services are appropriate for the viewing, access, or participation by individuals under the age of majority. If an individual under the age of majority uses the Website and Services, the individual may only use the Website and Services under the direct supervision of a parent or guardian of majority age.
MyPeople does not seek nor does it knowingly collect any Personal Information about children under thirteen (13) years of age. If MyPeople becomes aware it has unknowingly collected Personal Information from a minor under the age of thirteen (13), MyPeople will make commercially reasonable efforts to delete such information from its database.
If You are the parent or guardian of a minor child who has provided MyPeople with Personal Information, You may contact MyPeople directly by using the information below to request this information be deleted.
CALIFORNIA RESIDENTS’ PRIVACY RIGHTS
This Privacy Policy describes how MyPeople may share Your information for marketing purposes. If You are a California resident, California law may provide You with additional rights regarding MyPeople’s use of Your Personal Information. California residents may request a list of any Personal Information provided to third-parties in the preceding year for direct-marketing purposes. Accordingly, California residents can contact MyPeople by email at privacy@mypeople.earth and must attest that You are a California resident and provide a current California address for a response.
EUROPEAN UNION (“EU”) RESIDENTS’ PRIVACY RIGHTS
This Privacy Policy describes how MyPeople may share and process Your information for marketing purposes. If You are a resident of the EU, the General Data Protection Regulation (“GDPR”) provides You with additional rights regarding MyPeople’s use of Your Personal Information. This Privacy Policy follows the regulations of the GDPR, which addresses the transfer of Personal Information outside of the EU and the European Economic Area (“EEA”) when services are offered.
You are therefore explicitly and unambiguously consenting to the terms of this Privacy Policy prior to providing any of Your Personal Information to the Website. Under the application of EU regulations, You have the following rights with respect to Your Personal Information:
● To obtain a copy of Your Personal Information together with information about how and on what basis that Personal Information is processed;
● To correct incorrect Personal Information;

● To restrict processing of Your Personal Information where: (i) the accuracy of the Personal Information is contested; (ii) the processing is unlawful but You object to the erasure of the Personal Information; (iii) MyPeople no longer requires the Personal Information for the purposes it was collected, but it is required for the establishment, exercise, or defense of a legal claim; or (iv) You have objected to MyPeople processing Your Personal Information based on its legitimate interests, and MyPeople is considering Your objection;
● Where You have provided Your Personal Information to MyPeople with Your consent, You have the right to ask MyPeople for a copy of Your Personal Information in a structured format and to ask MyPeople to share this data to another data controller, if You so request;
● To obtain a copy of or access to safeguards under which Your Personal Information is transferred outside of the EEA; and
● You have the right to challenge and vocalize a complaint with a supervisory authority for data protection.
MyPeople may ask You for additional data to confirm Your identity and for other security purposes before disclosing data requested by You. MyPeople reserves the right to charge a fee where permitted by law. MyPeople will decline to process requests jeopardizing the privacy of others, requests that are extremely impractical, or requests which would cause MyPeople to take any action that is not permissible under applicable laws. Moreover, as permitted by applicable laws, MyPeople will retain where necessary for a limited period of time certain Personal Information related to record-keeping, accounting, and fraud prevention purposes.
Third-Party Online Advertising
MyPeople works with certain third-party advertising companies in connection with its online advertising. Those companies may in turn set cookies or other tracking technologies in connection with providing advertising related services. The European Digital Advertising Alliance (“EDAA”) has developed a guide to online behavioral advertising and has developed an opt-out page to manage online behavioral advertising preferences with participating EDAA member companies, which is available online at YourOnlineChoices.com. You may also be able to manage cookies placed on MyPeople’s site by using its Cookie Management Tool.
Retention of Information
MyPeople retains Your Personal Information while You have an account with it and while You continue to use or visit the Services. MyPeople will retain Your Personal Information for as long as it is reasonably necessary for the purposes set out in this Privacy Policy, while correspondingly taking into account the time period reasonably necessary to: (i) provide the Services to You; (ii) exercise the choices and rights You have requested; (iii) comply with MyPeople’s contractual obligations; (iv) enforce MyPeople’s terms for use of the Services; and (v) comply with legal and regulatory requirements.
UNITED KINGDOM (“UK”) RESIDENTS’ PRIVACY POLICY RIGHTS
This Privacy Policy describes how MyPeople may share and process Your information for marketing purposes. If You are a resident of the UK, the Data Protection Act 2018 (“DPA 2018”) applies to You and provides You with additional rights regarding MyPeople’s use of Your Personal Information. This Privacy Policy follows the DPA 2018, which controls how Your Personal Information is used by organizations, businesses, and/or the government.
The DPA 2018 requires fair processing of personal information, meaning that MyPeople shall be transparent in regard to the manner it collects and how it uses Your Personal Information. Under the application of UK regulations, You have the following rights with respect to Your Personal Information:
● Your Personal Information is processed lawfully, fairly, and in a transparent manner;
● The collection of Personal Information is for specified, explicit, and legitimate purposes and not further processed in a manner that is incompatible with those purposes. Further processing for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes shall not be considered to be incompatible with the initial purposes;
● The Personal Information is adequate, relevant, and limited to what is necessary in relation to the purposes it is processed;
● Your Personal Information is accurate and, where necessary, kept up-to-date. Every reasonable step must be taken to ensure any inaccurate Personal Information, having regard for the purposes it is processed, are erased or rectified without delay;
● Personal Information is kept in a form permitting identification of data subjects for no longer than is necessary for the purposes that the Personal Information is processed. Personal Information may be stored for longer periods insofar as the Personal Information will be processed solely for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes, subject to implementation of the appropriate technical and organizational measures required by the GDPR in order to safeguard the rights and freedoms of individuals;
● Personal Information is processed in a manner ensuring appropriate security of the Personal Information, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures; and
● MyPeople shall be responsible for and be able to demonstrate compliance with these terms.
The DPA 2018 is heavily tailored by the terms of the GDPR. The DPA 2018 applies to the types of processing data whereupon the GDPR utilizes and should be read as a supplement to the GDPR.
CANADIAN RESIDENTS’ PRIVACY POLICY RIGHTS
This Privacy Policy describes how MyPeople may share and process Your information for marketing purposes. If You are a resident of Canada, the Office of the Privacy Commissioner of Canada provides You with additional rights regulating MyPeople’s use of Your Personal Information. This Privacy Policy follows the regulations of the Personal Information Protection and Electronic Documents Act (“PIPEDA”), which sets out the ground rules for how businesses subject to the law must handle personal information in the course of commercial activities.
In addition to these terms, PIPEDA states any collection, use, or disclosure of Personal Information must only be for purposes that a reasonable person would consider appropriate under the circumstances. Thus, pursuant to PIPEDA, You have the following rights with respect to Your Personal Information:
● MyPeople is responsible for Your Personal Information under MyPeople’s control;
● The purposes for which the Personal Information is being collected must be identified by MyPeople before or at the time of collection;
● Both Your knowledge and consent are required for the collection, use, or disclosure of Personal Information, except where inappropriate in accordance with applicable data laws;
● The collection of Your Personal Information must be limited to what is needed for the purposes identified by MyPeople. Personal Information must be collected by fair and lawful means;
● Unless You consent otherwise, or it is required by law, Personal Information can only be used or disclosed for the purposes it was collected. Personal Information must only be kept as long as required to serve those purposes;
● Personal Information must be as accurate, complete, and up-to-date as possible in order to properly satisfy the purposes it is to be used;
● Personal Information must be protected by appropriate security relative to the sensitivity of the information;
● MyPeople agrees to make information about its policies and practices corresponding to the management of Your Personal Information publicly and readily available;
● Upon request, You must be informed of the existence, use, and disclosure of Your Personal Information and be given access to that information. You shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate; and
● You shall be able to challenge MyPeople’s compliance with the above principles by contacting MyPeople by email at privacy@mypeople.earth.
Furthermore, MyPeople collects Personal Information automatically through the electronic means referenced in this Privacy Policy. MyPeople indicates to Users that they can disable cookies and/or web beacons to prevent further data collection, unless such technology is deemed necessary for the electronic platform to properly function.
Please note that if You are a resident of the French-Canadian province of Quebec, You should refer to the EU Privacy Policy section. Quebec follows the privacy policy standards of the GDPR.
GOVERNING LAW
This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Maryland without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any jurisdiction other than the State of Maryland.
